1. General

We are dedicated to comply with the Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation, hereinafter as GDPR).

2. Definitions

Personal data means any information relating to an identified or identifiable natural person (‘data subject’); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person;

Processing means any operation or set of operations which is performed on personal data or on sets of personal data, whether or not by automated means, such as collection, recording, organisation, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction;

Restriction of processing means the marking of stored personal data with the aim of limiting their processing in the future;

Filing system means any structured set of personal data which are accessible according to specific criteria, whether centralised, decentralised or dispersed on a functional or geographical basis;

Controller means the natural or legal person, public authority, agency or other body which, alone or jointly with others, determines the purposes and means of the processing of personal data; where the purposes and means of such processing are determined by Union or Member State law, the controller or the specific criteria for its nomination may be provided for by Union or Member State law;

Processor means a natural or legal person, public authority, agency or other body which processes personal data on behalf of the controller;

Recipient means a natural or legal person, public authority, agency or another body, to which the personal data are disclosed, whether a third party or not. However, public authorities which may receive personal data in the framework of a particular inquiry in accordance with Union or Member State law shall not be regarded as recipients; the processing of those data by those public authorities shall be in compliance with the applicable data protection rules according to the purposes of the processing;

Third party means a natural or legal person, public authority, agency or body other than the data subject, controller, processor and persons who, under the direct authority of the controller or processor, are authorised to process personal data;

Consent of the data subject means any freely given, specific, informed and unambiguous indication of the data subject’s wishes by which he or she, by a statement or by a clear affirmative action, signifies agreement to the processing of personal data relating to him or her;

4. What data do we collect?

Personal data which the LAB collects and records throughout the certification process:

  • Name
  • Copy of ID or PASSPORT
  • Place of birth
  • Date of birth
  • Address
  • Contact information (E-mail and phone number)
  • Licence type and number

5. How do we collect your data?

The LAB collects your personal data in the following ways:

  • Registering online to purchase any of our services.
  • Voluntarily complete a customer survey
  • Use or view our website via your browser’s cookies.

6. How will we use your data?

The LAB collects your data so that we can:

  • acknowledge your purchase,
  • contact you with further information regarding the service you have purchased,
  • be able to conduct an assessment procedure related to your Aeronautical English Language Proficiency,

All of your data are considered as confidential and shall not be provided for a third party, except upon the request of the Estonian Transport Administration.

7. How do we store your data?

The LAB securely stores your data in a digital format.

The LAB will keep your data used for 12 years. Once this time period has expired, we will delete your data in a permanent manner.

8. Marketing

The LAB shall not send you messages for marketing purposes.

9. What are your data protection rights?

The LAB would like to make sure you are fully aware of all of your data protection rights. Every user is entitled to the following:

  • The right to access – You have the right to request the LAB for copies of your personal data.
  • The right to rectification – You have the right to request that the LAB correct any information you believe is inaccurate. You also have the right to request the LAB to complete the information you believe is incomplete.
  • The right to erasure – You have the right to request that the LAB erases your personal data, under certain conditions which do not compromise the traceability of your certification. If you request that the LAB erases those data as well, the LAB may be forced to withdraw your certification.
  • The right to restrict processing – You have the right to request that the LAB restricts the processing of your personal data, under certain conditions.
  • The right to object to processing – You have the right to object to the LAB processing of your personal data, under certain conditions.
  • The right to data portability – You have the right to request that the LAB transfers the data that we have collected to another organization, or directly to you, under certain conditions.
