Terms and Conditions

1. General

These Terms and Conditions are legally enforceable agreement between:

The AviationLAB OÜ, registry code: 17116267, Address: Estonia, Tallinn, Kotkapoja tn 2a-10, 10615, email address: hello@aviationlab.eu (hereinafter the LAB); and

The natural person who has purchased Language Proficiency Assessment Service (hereinafter the Candidate).

The LAB and the Candidate shall hereinafter be collectively referred to as the Parties.

2. Definitions

Assessment: process that evaluates the Candidate’s fulfilment of the requirements of the ICAO Aeronautical Language Proficiency.

Candidate is a natural person who has purchased the Aeronautical Language Proficiency Service Assessment service provided by the LAB.

Certification Processes: activities by which the LAB determines that the candidate fulfils certification requirements, including application, assessment, decision on certification and use of certificates.

Code of Conduct:: document specifying the ethical or personal behaviour required by the LAB.

Complaint: expression of dissatisfaction by a candidate to the LAB, relating to the activities of the LAB, where a response is expected.

Confidential information, considering the LAB, means the following information: see point 13.

Confidential information, considering the Candidate, means the following information:

  • All examination questions and tasks,
  • Any information related to the certification process with which another person would obtain additional advantage in further certifications.

Certificate: document issued by the LAB for the Candidate, including that the named person has demonstrated the competence required by the ICAO Aeronautical Language Proficiency.

Examination or Test: mechanism that is part of an assessment which measures a candidate’s competence by one or more means as defined by the certification scheme.

ICAO Language Proficiency CertificateICAO language proficiency certificate means the certificate required by the ICAO International Regulations, Commission Regulation (EU) No 1178/2011 (PART-FCL) for pilots, Commission Regulation (EU) 2015/340 (ATCO) for Air Traffic Controllers and by the competent Aviation Authority which issued the license.

Impartiality: presence of objectivity; conflict of interest do not exist, or are resolved, so as not to adversely influence subsequent activities of the LAB.

Scope of Certification: range and nature of specific tasks that the candidate is expected to perform competently.

Service: the service provided by the LAB covers the ICAO Language Proficiency Test in English Language.

Website: website means the website of http://www.aviationlab.eu

Withdrawal: cancellation of a certification or a certificate. 

3. Scope of terms and conditions

These Terms and Condition forms the basis of purchasing ICAO Language Proficiency Testing service available at point 4. Purchasing a service.

4. Purchasing a service

Language testing service can be purchased on the website of the LAB (www.aviationlab.eu). In order to initiate a request for (online) ICAO Language Proficiency Testing, the Candidate shall:

  • book an (online) appointment,
  • fill the form of application,
  • upload a copy of his/her ID or PASSPORT,
  • accept the Terms & Conditions, and
  • complete the payment of the service fee.
 

The LAB acknowledges the request for ICAO Language Proficiency Testing after all points mentioned above are fulfilled. The current Terms & Conditions becomes a legally binding agreement when the Candidate accept it throughout the application process (purchasing a service).

Coupon codes starting with ‘100’ are exclusively for our contracted partners. Applications that use these codes illegitimately will be rejected.

5. Service fee

The fee of (online) English ICAO Language Proficiency Assessment is 150 EUR, which shall be paid during the process of purchasing the Language Proficiency Assessment service. AviationLAB OÜ is a non-VAT registered company, consequently we do not charge for VAT.

6. Obligation of the Candidate

By accepting the Terms and Conditions of the LAB, the Candidate must comply with the following provisions of (online) testing:

  • With the acceptance of the Terms and Conditions, the Candidate acknowledges that all parts of the assessment procedure shall be recorded and stored confidentially by the LAB (see point 13.) for at least 10 years,
  • The Candidate must ensure a quiet and calm environment for languages testing,
  • The Candidate must ensure that his/her internet connection is appropriate (at least 50 Mbit/s download speed and at least 5 Mbit/s upload speed),
  • The Candidate must connect to the linked ZOOM platform by a device equipped with a camera:
  • During the exam, the Candidate must not wear a headset,
  • The Candidate must be the only person present in the room,
  • The Candidate must be available at the ZOOM platform at least 10 minutes before the scheduled appointment. The Candidate must acknowledge that being late from the exam prevents the LAB to fulfil its obligations to perform the assessment. In this case, the LAB is forced to close the assessment procedure without certification and the Candidate shall not receive a refund from the service fee.
  • The Candidate shall identify himself/herself with the same documentation (either ID or Passport) which he/she has completed the application with.
  • The Candidate shall not use and shall not attempt to use any written notes, any outside resources, any help of a third party or cheat in any other way during the assessment procedure. If the interlocutor establishes the fact of cheating, the LAB close the assessment procedure without certification and the Candidate loses his/her right to request a recertification. If the fact of cheating is established after the certification procedure (e.g. by evaluation of recorded material for quality purposes), the LAB shall withdraw the certification been provided to the Candidate and shall request the Candidate to discontinue the usage of the certification.
  • In case of Network Connection Breakdown from the side of the Candidate, the Candidate has 5 minutes to restore the connection. If he/she is unable to do that in that period, the LAB submit a report and the certification process cannot be continued.
  • The Candidate shall treat all information about the assessment as confidential, and he/she neither publishes this information nor shares it with a third party in any way.
  • The Candidate shall not use the certificate in a misleading manner.
  • Receiving a grade between 1 and 3 means a grade below the minimum ICAO Operational Level 4. In such a case, the Candidate holds the ultimate responsibility to contact the Aviation Authority in the license issuing state for further actions.

7. Obligation of the LAB

After the Candidate has completed the purchase of ICAO Language Proficiency Testing service described in point 4., the LAB must comply with the following previsions of (online) testing:

  • The LAB shall acknowledge the scheduled appointment by email and attach the invoice of the payment of the service,
  • The LAB shall consider all information about the candidate and the assessment of the candidate as confidential, and shall not provide any information to a third party, except upon the request of the Competent Authority (see point 13.),
  • The LAB is a third-party, ICAO Language Proficiency Assessment provider approved by the Estonian Transport Administration, and the LAB conducts all assessments in an impartial manner (see point 14.)
  • The LAB has the obligation to provide ICAO Language Proficiency Testing service in English language at the time of the appointment booked by the Candidate,
  • In case of Network Connection Breakdown from the side of the LAB, the LAB has 10 minutes to restore the connection. If the LAB is unable to do so, the LAB shall submit an internal report and a new appointment shall be provided to the Candidate,
  • The certification of the Candidate shall be provided by email within maximum 5 working days from the assessment.
  • The LAB acknowledges any appeal or complaint and deal them in a fair, responsible, and responsive manner.

8. Changes of scheduled appointment

For any unforeseen reason, in a single case the LAB can reschedule the appointment after contacting the Candidate.

The Candidate has the possibility to request a new appointment for the charge of 50 EUR. This request must be submitted not later than 36 hours before the original appointment.

9. Certification

The LAB accepts no responsibility for the non-achievement of the ICAO Language Proficiency Assessment.

The LAB shall provide a certificate to all certified persons and the LAB shall maintain sole ownership of the certifications.

10. Appeals and Complaints

The Candidate may submit complaints and appeals against actions and decisions of the certification body.

If the Candidate is not satisfied with any prevailed condition during the assessment procedures, he/she may submit, for free of charge, a complaint within maximum 48 hours after the assessment.

If the Candidate is not satisfied with the decision of the certification body, he/she may submit an appeal, for the charge of 50 EUR, within maximum 7 days after receiving the certification by email. In the event of an appeal, the LAB shall reevaluate the performance of the candidate based on the recorded material. If the appeal is granted, the candidate shall receive his/her new certification and the fee of the appeal shall be refunded. If the appeal is denied the fee of the appeal shall not be refunded.

The candidate can submit a complaint or an appeal by sending an email to the address of hello@aviationlab.eu. The minimum information must be included are:

  • Name of the Candidate,
  • Candidate number.
  • Date of the exam, and
  • Nature of the appeal: which aspect of the rating criteria is being appealed.

11. Cancellation

With the payment completed and the Terms and Conditions having been accepted, the request for testing cannot be cancelled.

12. Financial Security

The LAB uses an external payment provider, the Stripe platform, to process payment transactions with third-party companies. The LAB does not collect or save credit card data of the Candidate. The payment provider saves credit card and bank data in encrypted form. Payment shall take place by credit card or direct debit using Stripe.

13. Confidentiality

The LAB shall keep confidential all information obtained during the certification process and shall not provide any information to a third party, except upon the request of the Competent Authority.

Information about the candidate obtained from sources other than the candidate (e.g. from the complainant or from the Competent Authority) shall be treated by the LAB as confidential.

With the acceptance of the Terms and Conditions, the candidate obtaining any non-published information about the certification activity of the LAB (through the application or examination process e.g. exam questions) has the obligation to treat that information confidential and does not publish them or provide them to a third party.

14. Management of Impartiality

The LAB is independent in technical, financial and legal terms from Candidates or other parties interested in the results of the Language Proficiency Assessment.

ICAO Language Proficiency Certification of a person is based on evidence obtained by the LAB through objective, fair, impartial, valid and reliable assessment, and not influenced by other interests or by other parties.

The LAB has top management commitment to impartiality in ICAO Language Proficiency Assessment activities. All members of the LAB are responsible for impartiality and shall not allow any commercial, financial or other pressure to compromise this impartiality.

15. Settlement of Disputes and Applicable Law

Any disputes arising out of or relating to these Terms and Conditions which cannot be settled amicably shall be referred to the exclusive jurisdiction of the courts of Estonia.
